The difference in the statutes of limitations for mesothelioma claims, and other toxic and chemical exposure lawsuits, is due to the nature of the illness. Mesothelioma, as well as other diseases caused by exposure to asbestos, may not appear until two or more decades after the exposure occurred. Once diagnosed, a victim of asbestos exposure may have one to three years to file a claim, depending on their state.
Discovery involves lawyers from both sides of the lawsuit collecting information regarding your claims. There is no specific testing to determine if you were exposed to asbestos. However, if you were in the Navy, you should have a yearly chest X-ray or CT scan to check for asbestos-related diseases such as mesothelioma or lung cancer. If you are experiencing any shortness of breath, see your doctor immediately and advise your doctor that you served in the Navy.
